DAK Safety Platform: Terms of Service
DRAFT for review by DAK's lawyer before use. Version 2026-10-09.
These terms are an agreement between DAK Machine Safety Service, LLC ("DAK", "we") and the company that uses the DAK Safety Platform ("the customer"), and they also apply to each person who signs in for that company ("you").
1. Who we are
DAK Machine Safety Service, LLC, 320 1st Ave N Ste C, St. Petersburg, FL 33701, United States. E-mail: info@dakmachinesafety.com. Support: https://dak-service-desk.azurewebsites.net/
2. What the platform is
The DAK Safety Platform is an online service for machine safety work: Risk Assessment, Lockout Tagout and Validation, and the reports made from them. The modules a customer may use are the ones in its license.
3. Accounts
- DAK creates each customer company and its first company admin. The company admin invites the company's other people and decides what each one may see.
- You sign in with your Microsoft account. Your account is personal: do not share it, and do not let anyone else work under your name.
- Tell your company admin or DAK at once if you think someone else used your account.
- The customer is responsible for who it invites and for what its people do in the platform.
4. The license
- A license names the modules, the number of plants and the period (normally one year). DAK sets it; the customer cannot add plants beyond it, and asks DAK for more.
- Prices and payment are agreed with DAK directly, outside the platform. The platform takes no payment.
- Each license includes one free DAK service per licensed plant per license year. Unused free services do not carry over. Further services are charged as agreed with DAK.
- When a license ends, DAK may suspend the company's access. The company's data is not erased by the end of the license; DAK may delete it later, as agreed with the customer.
5. The customer's data
- The data the customer's people enter (plants, projects, machines, assessments, photos, reports) belongs to the customer.
- DAK uses it only to run the platform and to give the customer the services it asks for.
- Each company's data is kept apart from every other company's. DAK staff look at a company's data only to support that company or to give it a DAK service; each such visit is recorded in that company's audit log.
- DAK keeps the platform's security and audit records, which include who signed in and what was changed.
- How DAK handles personal information is described in the Privacy Policy.
6. Fair use
You must not:
- use the platform for anything unlawful;
- try to reach another company's data, or test or get around the platform's security, unless DAK has agreed to it in writing;
- copy, take apart or resell the platform's software;
- put so much load on the platform that it slows down for others;
- upload files that contain harmful code.
DAK may suspend an account or a company that breaks these rules, and will tell the customer why.
7. Safety results are the customer's responsibility
The platform helps qualified people record and report machine safety work. It does not replace their judgement. The customer remains responsible for the safety of its machines and people, for checking every assessment and report before relying on it, and for meeting the laws and standards that apply to it. Text suggested by the platform's writing helpers must be checked by the person who uses it.
8. The demo
A demo shows made-up sample data for a limited time (24 hours from the first sign-in). Nothing a demo user enters is saved on the platform; it stays only in that browser and is deleted when the demo ends. Demo reports are marked DEMO and must not be used for real work.
9. Availability and changes to the platform
DAK works to keep the platform available and its data backed up, but cannot promise that it will never be interrupted. DAK may improve and change the platform; it will not remove a module the customer has licensed during the license period without agreeing it with the customer.
10. Confidential information
Each side keeps the other's non-public business information confidential and uses it only for this agreement. This does not cover information that is already public, that the other side already had, or that a law or court requires to be disclosed.
11. What DAK is responsible for
The platform is provided as it is. Beyond what these terms say, DAK gives no promise that it fits a particular purpose. To the extent the law allows, DAK is not liable for indirect or consequential loss (for example lost profit or lost production), and DAK's total liability under this agreement is limited to what the customer paid DAK for the platform in the twelve months before the claim. Nothing here limits liability that the law does not allow to be limited.
12. Law and courts
These terms are governed by the laws of the State of Florida, United States. Disputes go to the state or federal courts serving Pinellas County, Florida, unless the customer and DAK agree on something else in writing.
13. Changes to these terms
DAK may update these terms. The platform shows the new version at the next sign-in, and you continue only after accepting it. The version and the time you accepted are recorded.
